Abstract

Provides advice on the planning process for dealing with proposals for nationally significant infrastructure projects (NSIPs). Aims to: provide a brief description of the legal context and obligations placed on both the decision maker and the applicant under the Habitats Directive and the Habitats Regulations; explain how the Planning Act 2008 process aligns with the Habitat Regulation Assessment (HRA) process; highlight the relevant bodies that should be consulted by the applicant throughout the development consent application process, and the suggested timing and level of engagement; clarify the information to be provided with a development consent application with respect to HRA; and explain the process that will be carried out by the Planning Inspectorate as part of their duties and the interface with HRA which will be followed to seek compliance with the legal requirements.
