Explanatory Memorandum

Abstract

Relates to SI 2012/1151 which amends SI 2007/175 to reduce the range and level of fixed penalties under section 47ZB of the Environmental Protection Act 1990 (EPA) which can be specified by a waste collection authority. Also relates to SI 2012/1150 which amends section 47ZB of the EPA to reduce the default amount if a local authority does not specify the amount of the penalty under the fixed penalty notice.

Prepared by Department for Environment, Food and Rural Affairs (DEFRA). Part relating to SI 2012/1151 no longer applicable as this Statutory Instrument has been revoked by SI 2017/1050.
