Abstract

Presents the options and impacts considered for the proposals to amend and consolidate the Public Contracts (Scotland) Regulations 2006 (SSI 2006/1) and the Utilities Contracts (Scotland) Regulations 2006 (SSI 2006/2). The amendments remove uncertainty in bringing court proceedings in Scotland for breaches of EU procurement law, ensure that public bodies and utilities take into account the requirements of the Bribery Act 2010 and the Criminal Justice and Licensing (Scotland) Act 2010 and consolidate the 2006 regulations and their subsequent amendments.
