Abstract

Investigates the case for a right for third parties in the planning system to appeal on merits to a higher authority against the decision of a local planning authority to grant planning permission. Evaluates whether it is necessary or desirable in principle, if so how it might work in context of the British planning system. Also whether British law needs to be changed to introduce a third party right of appeal to conform with the Human Rights Act 1998.
