Explanatory Memorandum
Abstract
Relates to the Town and Country Planning (General Development Procedure) (Amendment No. 3) (England) Order 2009, SI 2009/2261 which amends the Town and Country Planning (General Development Procedure) Order 1995 (S.I. 1995/419) for the purpose of implementing section 190 of the Planning Act 2008. The Order also amends the procedure for applications under section 73 of the Town and Country Planning Act 1990 for permission to develop land without conditions previously attached and introduces a new procedure for dealing with applications to replace an extant planning permission which meets specified criteria. Also relates to the Planning (Listed Buildings and Conservation Areas) (Amendment) (England) Regulations 2009, SI 2009/2262, which amend the Planning (Listed Buildings and Conservation Areas) Regulations 1990 (S.I. 1990/1519) to remove the requirement for a design and access statement, and additional copies, where applications to replace an extant consent meet specified criteria.
